We are delighted that you have shown interest in the services of On-the-Job-Training (“OJT”)  which are provided via https://ojt.com (the “Website”, “Business”). Data protection is a particularly high priority for the management of OJT. This privacy statement discloses what information we gather and how we use it.

Key aspects of our privacy practices described in this Privacy Policy include the following explanations:

1. Personal Data That We Collect:

Our services require you to provide us with Personal Data. If you choose to withhold any Personal Data requested by us, it may not be possible for you to gain access to parts of the Website and for us to respond to your query. We, as Controllers, use the information we collect to operate and maintain our Website and the Services offered, send you marketing communications and respond to your questions and concerns. The Personal Data which you may provide to us could include, but is not limited to:

  • Your Last Name,
  • Your Gender (optional),
  • Your Age and date of birth,
  • Your Email address,
  • Your phone number,
  • Your Resume other video or audio profile of you, audio likeness and tone of member,

  • Your identification documents including company verification documents and photographs;
  • Any other information or data required for the operation of the Website and Services provided through the Website.

2. Non-Personal Data That We Collect:

When you access our Service, we may automatically collect non-personal data from you, such as IP host address, pages viewed, operating system, referring service, search information, device type, page views, usage and browsing habits on the Service, and other similar data. We may also aggregate demographic information collected from our users (such as the number of customers in a particular geographical location) in a manner which does not identify any one individual. We may also aggregate information collected offline in connection with the Service, obtain non-personal data from third party sources and develop aggregate information by anonymizing previously collected personal data.

We may gather through tracking information derived from visitor behavior and interactions with our website and digital communications: This information allows us to better understand our readers’ interests and tailor our content accordingly and also to help our advertisers and sponsors better understand the interests, behavior and demographics of our audience.

  • We may share personal data, with third party service providers who perform various functions to enable us to provide our Services and help us operate our business, such as to the Trainers, to the Career Seekers, website design, sending email communications, telephone communication, text messaging, advertising, fraud detection and prevention, customer care, third party surveys or performing analytics. These companies are authorized to use your personal information only as necessary to provide these services to us. Our contracts with these third parties require them to maintain the confidentiality of the personal information we provide to them, only act on our behalf and under our instructions, and not use personal information for purposes other than the product or service they are providing to us or on our behalf. We urge you to read privacy practices of all third-party vendors before submitting any personal data through the Service.
  • We may share aggregated demographic information about our customers, sales, and traffic to our partners and advertisers. We will not give, sell, rent, share, or trade any of your personal information or any data that you store using our services to any third party except as outlined in this Privacy Policy or with your consent. We may disclose information to a third party to (a) comply with laws or respond to lawful requests and legal process, (b) to protect OJT, agents, customers, and others including to enforce our agreements, policies and terms of use or (c) in the good faith belief that disclosure is needed to respond to an emergency, or protect the personal safety of any person.
  • We may disclose personal data as required by law or legal process.
  • We may disclose personal data to investigate suspected fraud, harassment or other violations of any law, rule or regulation, or the terms or policies for our services or our sponsors.
  • We may transfer your personal data in connection with the sale or merger or change of control of OJT or the division responsible for the services with which your personal data is associated.
  • We may share your personal data with an affiliate of OJT who is in the same corporate family as us as long as their privacy practices are substantially similar to ours.
  • We may use your personal data to send you a welcoming email and to contact you about your use of the Website and services; to respond to your emails, submissions, comments, requests or complaints; to perform after-sales services; to anticipate and resolve problems with our service; to respond to customer support inquiries, for assistance with our product and service development; and to inform you of updates to products and services from OJT that better meet your needs.

Marketing

  • Notwithstanding anything in this Agreement if you no longer want to receive marketing communications from us, you can change your preferences at any time by contacting us (details below), clicking on the ‘unsubscribe’ link in any email, or updating your settings in your account. If you unsubscribe from marketing, please note we may still contact you with service messages from time to time (e.g. order and delivery confirmations, and information about your legal rights).

6. Cookies:

The Website use cookies. Cookies are text files that are stored in a device. Many applications use cookies. Through the use of cookies, OJT can provide the users of the Website with more customer-friendly services that would not be possible without the cookie setting.

By means of a cookie, the services on the Website can be optimized with the customer in mind. Cookies allow us, to recognize our customers. The purpose of this recognition is to make it easier for users to utilize our Website.

OJT may use third parties, including Google, to show you OJT ads when you visit different sites on the internet. These third parties use cookies to collect non-personal information and show ads based on your prior visits to the OJT’s website. 7. Contact possibility via the Website:

The Website contains information that enables a quick electronic contact to our enterprise, as well as the Trainers. If you contact OJT or Trainers via Website or via a contact form, the personal data transmitted by you is automatically stored. Such personal data transmitted on a voluntary basis by you to OJT or Trainers, are stored for the purpose of processing or contacting you. There may be transfer of this personal data to third parties.

8. Protection for Children:

The use of Website is intended for and directed to adults as well as kids. Therefore we may collect personal information from minor under 13, such collection and use, to the extent applicable, shall, when required, be done in compliance with the children’s online privacy protection laws and appropriate consent from the child’s parent or guardian will be sought where required by law. When we become aware that personal data from a child under 13 has been collected without such child’s parent or guardian’s consent, we will use all reasonable efforts to delete such information from our database.

If a child is between the age of 13 and 16 years, a manual consent will be taken from such child before collection and use, to the extent applicable, shall, when required, be done in compliance with the children’s online privacy protection laws.

9. Routine erasure and blocking of personal data:

OJT shall process and store the personal data of the customers only for the period necessary to achieve the purpose of storage, or as far as this is granted by law.

10. Third-Party Data Processors:

In order for our Website and Services to function, we need to share limited customer data with third-party services. Below is a list of third-party services that have access and permission to process certain customer data. Each third-party service is reliable and has data protection guarantees approved by OJT. 11. Your rights

If you are a Consumer under the California Consumer Protection Act you have certain rights in respect of your personal data, including the right to access, portability, non- discrimination, correct and request the erasure of your personal data. You shall acquire these rights against us, only in the event of the Business becoming subject to the California Consumer Protection Act.

Right to access

  • You have the right to request that OJT disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive your verifiable request, we will disclose to you:
  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The specific pieces of personal information we collected about you

 

  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
  • Sales, identifying the personal information that each category of recipient purchased; and
  • Disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Right to non- discrimination

  • We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
  • However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels.

Right of erasure or deletion

  • You have the right to request that OTJ delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546  seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Verifiable Customer Request

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

You also have the right to object to your personal data being used for certain purposes, including to send you marketing. See ‘Marketing’ above in clause-3, for more details of how to opt-out of marketing.

We will comply with any requests to exercise your rights in accordance with applicable law. Please be aware, however, that there are a number of limitations to these rights, and there may be circumstances where we are not able to comply with your request. To make any requests regarding your personal data, or if you have any questions or concerns regarding your personal data, you should contact us using the details below. You are also entitled to contact your local supervisory authority for data protection.

12. Changes to this Privacy Policy:

We reserve the right, at our discretion, to change, modify, add, or remove portions from this Privacy Policy at any time. However, if at any time in the future we plan to use personal data in a way that materially differs from this Privacy Policy, including sharing such information with more third parties, we will post such changes here and provide you the opportunity to opt-out of such differing uses.

Privacy Policy will be updated in every calendar 12 months. When we make changes to this privacy notice, we will post the updated notice on the Website and update the notice’s effective date.

Your continued use of the Service and our services following the posting of any changes to this Privacy Policy means you accept such changes.

13. Governing Law:

This Privacy Policy and our legal obligations hereunder are subject to the laws of state of California, regardless of your location. You hereby consent to the exclusive jurisdiction of and venue in the courts located in the state of California in all disputes arising out of or relating to the Services or Website.
